These Terms of Use (“Terms”) are between you (“you,” “your”) and Hoteles.Guru (“Hoteles.Guru,” “we,” “our,” or “us”) and govern your use of Hoteles.Guru’s partner websites and Partner Central, including, without limitation, Hoteles.Guru and partner.Hoteles.Guru (collectively, the “Site”). By using the Site, you agree to the practices and terms described herein.
BY USING THE SITE, YOU: (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS; (B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT; AND (C) ACCEPT THESE TERMS AND AGREE THAT YOU ARE LEGALLY BOUND BY THEM. IF YOU DO NOT OR CANNOT AGREE TO THESE TERMS, DO NOT USE THE SITE.
We may revise or update these Terms from time to time. Changes become effective when posted on the Site, unless a later effective date is stated. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the revised Terms. These Terms are current as of the date shown above.
All information we collect through or in connection with the Site is subject to our Privacy Statement. By using the Site, you consent to actions taken by Hoteles.Guru with respect to your information in accordance with that Privacy Statement and applicable law.
All information, artwork, text, video, audio, media files, images, software, and other materials displayed on or contained within the Site (collectively, the “Content”) are owned by Hoteles.Guru or its third-party licensors. Hoteles.Guru and its third-party licensors retain all right, title, and interest in and to the Content and all related intellectual property rights. Your use of the Site does not grant you any ownership interest in the Content or the Site.
The Site and Content are protected by applicable U.S. and international intellectual property and proprietary-rights laws, which may include copyright, trademark, patent, and trade-secret laws. You may use the Site solely for your personal or internal business use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or resell the Site or any Content except as expressly permitted by Hoteles.Guru in writing.
All brands, names, logos, product and service names, designs, and slogans incorporated into the Site (collectively, the “Hoteles.Guru Marks”) are owned by Hoteles.Guru, its affiliates, or its licensors. You may not use the Hoteles.Guru Marks without Hoteles.Guru’s prior written permission.
The Site may provide links to third-party websites or websites of Hoteles.Guru’s affiliates or related companies (“Unrelated Sites”). These links are provided solely for your convenience and are not governed by these Terms. Your access to, reliance on, and use of any Unrelated Site are at your own risk and subject to that site’s terms and conditions. Hoteles.Guru is not responsible or liable for the content of, or your use of, any third-party website. The inclusion of a link does not imply endorsement of the linked site or its materials.
You agree to comply with all applicable federal, state, local, and international laws and regulations when using the Site. Without Hoteles.Guru’s express prior written permission, you may not:
access, monitor, or copy Content or information on the Site using a robot, spider, scraper, automated means, or manual process for any purpose;
violate restrictions in robot-exclusion headers or bypass or circumvent measures employed to prevent or limit access to the Site;
take any action that imposes, or may impose in Hoteles.Guru’s reasonable judgment, an unreasonable or disproportionately large load on Hoteles.Guru’s infrastructure;
deep-link to any portion of the Site for any purpose; or
frame, mirror, or otherwise incorporate any part of the Site into another website.
As a condition of your use of the Site, you agree that: (a) you are responsible for maintaining the confidentiality of your account credentials and password; (b) you may not use another person’s account to access the Site; (c) you must promptly notify Hoteles.Guru if you detect unauthorized use of your account; and (d) you are responsible for activities that occur through your account, except to the extent caused by Hoteles.Guru.
Hoteles.Guru reserves the right to take any action it determines is necessary if it believes your use of the Site violates these Terms, infringes the rights of any person or entity, threatens the personal safety of any person or entity, constitutes a Prohibited Use, or could create liability for Hoteles.Guru. Any action taken by Hoteles.Guru does not limit its rights or remedies at law or in equity.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND DEFECTS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties arising from course of dealing, course of performance, or usage of trade. Hoteles.Guru does not warrant that the Site will meet your requirements, achieve any intended results, be compatible with other software, applications, systems, or sites, operate without interruption, meet any performance or reliability standard, be error-free, or that errors or defects will be corrected, or that the Site is free of viruses or other harmful components.
Hoteles.Guru may make improvements, changes, or updates to the Site at any time. The inclusion of any particular product or service on the Site does not constitute an endorsement or recommendation by Hoteles.Guru.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR CERTAIN STATUTORY RIGHTS. TO THE EXTENT REQUIRED BY APPLICABLE LAW, SUCH EXCLUSIONS OR LIMITATIONS WILL NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Hoteles.Guru will not be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in any way connected with your access to or use of the Site, or any delay or inability to access, display, or use the Site, whether based on negligence, contract, tort, strict liability, or otherwise, even if Hoteles.Guru has been advised of the possibility of such damages.
If, despite the foregoing limitation, Hoteles.Guru is found liable for any loss or damage arising out of or connected with the matters described above, Hoteles.Guru’s aggregate liability will not exceed the greater of (a) the fees, if any, you paid to Hoteles.Guru for access to the Site during the twelve months preceding the event giving rise to the claim, or (b) US$100.00, except to the extent a different limitation is required by applicable law.
These limitations reflect the allocation of risk between the parties and will survive termination of these Terms or your right to use the Site, to the extent permitted by law.
You agree to indemnify, defend, and hold harmless Hoteles.Guru, its affiliates, and their respective officers, directors, employees, agents, successors, and assigns from and against claims, causes of action, demands, recoveries, losses, damages, fines, penalties, and other costs or expenses, including reasonable legal and accounting fees, arising from or relating to: (a) your breach of these Terms; (b) your violation of any law or third-party rights; or (c) your use of the Site or Content.
We appreciate hearing from you. If you submit suggestions, comments, or other feedback relating to the Site or Content (collectively, “Submissions”), you grant Hoteles.Guru all rights, title, and interest in and to those Submissions to the extent permitted by applicable law. You agree to provide reasonable assistance, at Hoteles.Guru’s request, to document, perfect, or maintain Hoteles.Guru’s rights in the Submissions. You also represent that your Submissions will not infringe the rights of any third party. If you do not agree to these terms, please do not provide Submissions.
Governing Law and Venue. These Terms and your use of the Site will be governed by applicable law. To the extent legally permitted, you consent to the exclusive jurisdiction and venue of the courts located in King County, Washington, USA, for disputes arising out of or relating to these Terms or use of the Site.
Severability. If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
No Waiver. Hoteles.Guru’s failure or delay in enforcing any provision of these Terms does not waive its right to enforce that provision or any other provision in the future.
Entire Agreement. These Terms constitute the entire agreement between you and Hoteles.Guru with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, concerning the Site.
Survival. Provisions that by their nature should survive termination, including provisions relating to intellectual property, confidentiality/privacy, indemnification, limitations of liability, governing law, and enforcement, will survive termination.
Injunctive Relief. You acknowledge that a breach of these Terms may cause irreparable harm for which monetary damages may be inadequate. To the extent permitted by law, Hoteles.Guru may seek temporary, preliminary, or permanent injunctive relief, in addition to any other remedies available at law or in equity.

14.1 The parties. The operator of hoteles.guru is Centro Multicultural Mindfulness, S.A.S., with address at Av. Jesús del Monte 37, Jesús del Monte, C.P. 52763, Huixquilucan, Estado de México, Mexico ("Hoteles.Guru"). The hotel accepting these Terms when submitting its listing application is the other party ("the Hotel").
14.2 Commission. The Hotel shall pay Hoteles.Guru a commission of ten percent (10%) of the accommodation value of each confirmed reservation booked through the platform. The commission is calculated on the accommodation charge and excludes IVA and the Lodging Tax, which are taxes the Hotel remits to the authorities and are not its income.
14.3 How the commission is covered. On signing up, the Hotel chooses one of two models, which determines the price shown to the public:
The Hotel may change models by written request to admin@hoteles.guru. A change applies only to later reservations, never to reservations already confirmed.
14.4 Deposit. The Hotel also chooses how much the guest pays at booking: 100% of the stay, a 50% deposit with the balance paid directly at the Hotel on arrival, or both options, letting each guest choose. Under any of these, the commission is always calculated on the full reservation value.
14.5 Automated settlement and split authorisation. Payments are processed through a payment gateway with automated splitting (currently Mercado Pago, and Stripe in due course). By connecting its collection account, the Hotel expressly authorises Hoteles.Guru and its designated processors to separate and route the 10% commission at the moment the guest pays. Accordingly, the Hotel never transfers funds to Hoteles.Guru and is never invoiced for collection: no balances accrue, there are no payment dates to meet, and no suspension for unpaid commission can arise. Where the guest pays only a deposit, the full commission is taken from that first payment.
14.6 Payout timing. Funds due to the Hotel are released from confirmation of the reservation, not from the guest's arrival: within 24 hours where payment is processed by Mercado Pago, and within 3 to 5 business days where processed by Stripe. These timings depend on the payment processor and not on Hoteles.Guru.
14.7 Confidentiality towards the guest. The commission breakdown is never shown to the guest. The model the Hotel chooses determines only whether the published price includes the markup or is its base rate.
14.8 Cancellations and refunds. Where a reservation is cancelled under the applicable policy and refunded to the guest, the commission is refunded in the same proportion as the amount returned. Where the Hotel retains all or part of the deposit under its cancellation policy, Hoteles.Guru retains the commission corresponding to the amount retained.
14.9 Tax obligations. The Hotel is responsible for issuing the guest the applicable tax receipt for the accommodation service and for remitting IVA and the Lodging Tax. Hoteles.Guru will issue the Hotel the corresponding tax receipt for its commission.
14.10 Rates set by the Hotel. Rates the Hotel expressly sets for particular dates are not altered by any automatic adjustment by Hoteles.Guru. A decision by the Hotel always prevails over any automatic rate rule.
These Terms govern use of Hoteles.Guru’s partner websites and Site access. They do not, by themselves, establish or replace separate commercial agreements concerning hotel inventory, rates, service levels, connectivity/API integrations, or other partner-specific business terms. Commission, payment collection, splitting, payout timing, cancellations and refunds are governed by section 14 above. Where applicable, those matters should be covered by a separate written partner agreement or applicable program terms.

Su uso continuado del Sitio después de que se publiquen los Términos modificados constituirá su aceptación de dichos Términos modificados. Toda la información que recopilemos a través del Sitio o en relación con este estará sujeta a nuestra Declaración de Privacidad. Hoteles.Guru no garantiza que el Sitio satisfaga sus requisitos, alcance los resultados previstos, sea compatible con otro software, aplicaciones, sistemas o sitios web, funcione sin interrupciones, cumpla con cualquier estándar de rendimiento o confiabilidad, esté libre de errores, o que cualquier error o defecto sea corregido. Hoteles.Guru podrá realizar mejoras, modificaciones o actualizaciones al Sitio en cualquier momento. La inclusión de cualquier producto o servicio específico en el Sitio no constituye un respaldo, recomendación o aprobación de dicho producto o servicio por parte de Hoteles.Guru.
ALGUNAS JURISDICCIONES NO PERMITEN LA EXCLUSIÓN O LIMITACIÓN DE GARANTÍAS IMPLÍCITAS O DE CIERTOS DERECHOS ESTABLECIDOS POR LA LEY. EN LA MEDIDA EN QUE LA LEGISLACIÓN APLICABLE LO EXIJA, DICHAS EXCLUSIONES O LIMITACIONES NO SE APLICARÁN A USTED.
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEGISLACIÓN APLICABLE, HOTELES.GURU NO SERÁ RESPONSABLE POR NINGÚN DAÑO DIRECTO, INDIRECTO, PUNITIVO, INCIDENTAL, ESPECIAL, CONSECUENTE O EJEMPLAR QUE SURJA DE O ESTÉ RELACIONADO DE CUALQUIER MANERA CON SU ACCESO O USO DEL SITIO, O CON CUALQUIER RETRASO O IMPOSIBILIDAD DE ACCEDER, VISUALIZAR O UTILIZAR EL SITIO, YA SEA POR NEGLIGENCIA, CONTRATO, RESPONSABILIDAD CIVIL, RESPONSABILIDAD OBJETIVA O CUALQUIER OTRA CAUSA, INCLUSO SI HOTELES.GURU HUBIERA SIDO INFORMADO DE LA POSIBILIDAD DE DICHOS DAÑOS.
Si, a pesar de la limitación anterior, se determina que Hoteles.Guru es responsable por cualquier pérdida o daño derivado de o relacionado con los asuntos descritos anteriormente, la responsabilidad total acumulada de Hoteles.Guru no excederá la cantidad mayor entre: (a) las tarifas, si las hubiera, que usted haya pagado a Hoteles.Guru por acceder al Sitio durante los doce meses anteriores al hecho que originó la reclamación; o (b) US$100.00, excepto cuando la legislación aplicable exija una limitación diferente.
Estas limitaciones reflejan la distribución de riesgos entre las partes y continuarán vigentes después de la terminación de estos Términos o de su derecho a utilizar el Sitio, en la medida permitida por la legislación aplicable.
Usted acepta indemnizar, defender y mantener indemne a Hoteles.Guru, sus afiliadas y sus respectivos funcionarios, directores, empleados, agentes, sucesores y cesionarios frente a cualquier reclamación, causa de acción, demanda, recuperación, pérdida, daño, multa, sanción y otros costos o gastos, incluidos honorarios razonables de abogados y contadores, que surjan de o estén relacionados con: (a) su incumplimiento de estos Términos; (b) su violación de cualquier ley o de los derechos de terceros; o (c) su uso del Sitio o del Contenido.
Agradecemos recibir sus comentarios. Si usted proporciona sugerencias, comentarios u otros comentarios relacionados con el Sitio o el Contenido (colectivamente, las "Comunicaciones"), usted concede a Hoteles.Guru todos los derechos, títulos e intereses sobre dichas Comunicaciones en la medida permitida por la legislación aplicable. Usted acepta proporcionar asistencia razonable, cuando Hoteles.Guru lo solicite, para documentar, perfeccionar o mantener los derechos de Hoteles.Guru sobre dichas Comunicaciones. Asimismo, usted declara que sus Comunicaciones no infringirán los derechos de ningún tercero. Si no está de acuerdo con estos términos, no proporcione Comunicaciones.
Legislación Aplicable y Jurisdicción. Estos Términos y su uso del Sitio se regirán por la legislación aplicable. En la medida legalmente permitida, usted acepta la jurisdicción exclusiva y competencia de los tribunales ubicados en el Condado de King, Washington, Estados Unidos, para cualquier controversia que surja de o esté relacionada con estos Términos o con el uso del Sitio.
Divisibilidad. Si cualquier disposición de estos Términos es declarada inválida, ilegal o inaplicable por un tribunal competente, las disposiciones restantes continuarán vigentes y serán plenamente exigibles.
No Renuncia. El hecho de que Hoteles.Guru no haga valer o se retrase en hacer valer cualquier disposición de estos Términos no constituirá una renuncia a su derecho de hacer valer dicha disposición o cualquier otra disposición en el futuro.
Acuerdo Completo. Estos Términos constituyen el acuerdo completo entre usted y Hoteles.Guru con respecto al Sitio y sustituyen todas las comunicaciones y propuestas anteriores o contemporáneas, ya sean electrónicas, orales o escritas, relacionadas con el Sitio.
Supervivencia. Las disposiciones que, por su naturaleza, deban permanecer vigentes después de la terminación, incluyendo aquellas relacionadas con propiedad intelectual, confidencialidad y privacidad, indemnización, limitaciones de responsabilidad, legislación aplicable y cumplimiento, continuarán vigentes después de la terminación.
Medidas Cautelares. Usted reconoce que el incumplimiento de estos Términos puede causar un daño irreparable para el cual una compensación monetaria podría ser insuficiente. En la medida permitida por la legislación aplicable, Hoteles.Guru podrá solicitar medidas cautelares temporales, preliminares o permanentes, además de cualquier otro recurso disponible conforme a la ley o a los principios de equidad.

14.1 Las partes. El operador del sitio hoteles.guru es Centro Multicultural Mindfulness, S.A.S., con domicilio en Av. Jesús del Monte 37, Jesús del Monte, C.P. 52763, Huixquilucan, Estado de México, México (en adelante, "Hoteles.Guru"). El hotel que acepta estos Términos al enviar su solicitud de alta es la otra parte (en adelante, "el Hotel").
14.2 Comisión. El Hotel pagará a Hoteles.Guru una comisión equivalente al diez por ciento (10%) del valor del hospedaje de cada reservación confirmada a través de la plataforma. La comisión se calcula sobre el hospedaje, sin incluir el IVA ni el Impuesto Sobre Hospedaje, por tratarse de contribuciones que el Hotel entera a la autoridad y que no constituyen ingreso suyo.
14.3 Cómo se cubre la comisión. Al darse de alta, el Hotel elige uno de dos esquemas, que determina el precio que ve el público:
El Hotel puede cambiar de esquema mediante solicitud por escrito a admin@hoteles.guru. El cambio aplica únicamente a reservaciones posteriores y nunca a reservaciones ya confirmadas.
14.4 Anticipo. El Hotel elige también cuánto paga el huésped al momento de reservar: el 100% de la estancia, el 50% como anticipo — liquidando el resto directamente en el Hotel a su llegada — o ambas opciones, dejando que cada huésped elija. Cualquiera que sea el esquema, la comisión se calcula siempre sobre el valor total de la reservación.
14.5 Cobro automatizado y autorización de reparto. Los cobros se procesan mediante una pasarela de pagos con reparto automático (actualmente Mercado Pago, y en su momento Stripe). Al conectar su cuenta de cobro, el Hotel autoriza expresamente a Hoteles.Guru y a los procesadores designados a separar y enrutar la comisión del 10% en el mismo momento en que el huésped realiza su pago. En consecuencia, el Hotel nunca transfiere fondos a Hoteles.Guru ni recibe factura por cobrar: no se generan adeudos, no hay fechas de pago que cumplir y no procede suspensión alguna por falta de pago de comisiones. Cuando el huésped paga únicamente el anticipo, la comisión completa se separa de ese primer cobro.
14.6 Plazos de pago al Hotel. Los fondos que corresponden al Hotel se liberan a partir de la confirmación de la reservación, no de la llegada del huésped: dentro de las 24 horas siguientes cuando el cobro se procesa por Mercado Pago, y entre 3 y 5 días hábiles cuando se procesa por Stripe. Estos plazos dependen del procesador de pagos y no de Hoteles.Guru.
14.7 Confidencialidad frente al huésped. El desglose de la comisión no se muestra al huésped en ningún momento. El esquema que el Hotel elija determina únicamente si el precio publicado incluye el recargo o corresponde a su tarifa base.
14.8 Cancelaciones y reembolsos. Cuando una reservación se cancela conforme a la política aplicable y se reembolsa al huésped, la comisión se reembolsa en la misma proporción que el monto devuelto. Si el Hotel retiene total o parcialmente el anticipo conforme a su política de cancelación, Hoteles.Guru conserva la comisión correspondiente a la cantidad retenida.
14.9 Obligaciones fiscales. El Hotel es responsable de expedir al huésped el comprobante fiscal que corresponda por el servicio de hospedaje, así como de enterar el IVA y el Impuesto Sobre Hospedaje. Hoteles.Guru expedirá al Hotel el comprobante fiscal correspondiente a su comisión.
14.10 Tarifas fijadas por el Hotel. Las tarifas que el Hotel establezca de forma expresa para fechas determinadas no son modificadas por ningún ajuste automático de Hoteles.Guru. Una decisión del Hotel prevalece siempre sobre cualquier regla automática de tarifas.
Estos Términos regulan el uso de los sitios web para socios de Hoteles.Guru y el acceso al Sitio. Por sí mismos, estos Términos no establecen ni sustituyen acuerdos comerciales independientes relacionados con inventario hotelero, tarifas, niveles de servicio, integraciones de conectividad/API u otros términos comerciales específicos de los socios. La comisión, el cobro, el reparto automático, los plazos de pago, las cancelaciones y los reembolsos sí están regulados por la cláusula 14 anterior. Cuando corresponda, dichos asuntos deberán estar regulados mediante un acuerdo de colaboración o asociación independiente por escrito, o mediante los términos y condiciones específicos del programa aplicable.
